    • Wizards of the Coast and their confusing legal policies

      As many of you may already know, Axis & Allies is owned by Avalon Hill, which is owned by Wizards of the Coast, which is owned by Hasbro. Wizards of the Coast has a very strange fan content policy. It says…

      We (that’s Wizards of the Coast) are continuously amazed at our Community’s creativity and engagement. We love that you enjoy creating and sharing Fan Content (that’s the stuff you make) and we want to encourage you to continue to create and share your stuff!

      You probably have a lot of questions about what you can and can’t do with Wizards’ intellectual property (IP), so we summoned our law mages to put together this Fan Content Policy and FAQ. We hope that you understand that any restrictions in this Fan Content Policy are intended to protect Wizards and its games. We’ve got to protect our IP if we want to keep the lights on!

      In short, your use of Wizards’ IP in your Fan Content is governed by the same rules you learned on the playground: share freely, keep it clean, and don’t hurt others.

      That means we ask you follow these rules:

      One word: F-R-E-E. You can use Wizards’ IP (except for the restrictions listed in #3) to make Fan Content that you share with the community for free. Free means FREE:
      You can’t require payments, surveys, downloads, subscriptions, or email registration to access your Fan Content;
      You can’t sell or license your Fan Content to any third parties for any type of compensation; and
      Your Fan Content must be free for others (including Wizards) to view, access, share, and use without paying you anything, obtaining your approval, or giving you credit.
      You can, however, subsidize your Fan Content by taking advantage of sponsorships, ad revenue, and donations—so long as it doesn’t interfere with the Community’s access to your Fan Content.

      Tell the Community it’s unofficial. Make it clear that your Fan Content is not endorsed or sponsored by Wizards—i.e., unofficial. Please include a note with your Fan Content explaining that:
      “[Title of your Fan Content] is unofficial Fan Content permitted under the Fan Content Policy. Not approved/endorsed by Wizards. Portions of the materials used are property of Wizards of the Coast. ©Wizards of the Coast LLC.”

      Don’t hurt others. Please respect other people’s IP. If you don’t have the rights to use another person’s stuff in your Fan Content—don’t. If we learn that your Fan Content also includes other people’s IP (e.g., crossovers/mashups) without their permission, we may ask you to take it down.
      Don’t hurt Wizards. We ask that you refrain from doing any of the following:
      Don’t use Wizards’ logos and trademarks. We’ve included a list of our most frequently asked-about trademarks in the FAQ;
      Don’t mess with the legal notices in our stuff. If the Wizards IP you are incorporating into your Fan Content already has copyright notices, logos, trademarks, or other notices existing within it, don’t remove them;
      Don’t use Wizards’ IP in other games. This includes your own or other people’s games or game components (e.g., rule books, tokens, figures), regardless of whether it is distributed for free;
      Don’t use Wizards’ Video or Music in your Fan Content. We know our video trailers are awesome, but use of our videos and music are governed by contracts with third parties. Please don’t use any of our video or music content, unless you’re embedding a video from an authorized third-party’s website (e.g., Twitch or YouTube);
      No bad stuff. We have the right to stop or restrict your use of Wizards’ IP at any time—for any reason or no reason—including when we think your use is inappropriate, offensive, damaging, or disparaging (and we’ll make that call in our sole discretion). If this happens, you must immediately take down your Fan Content or face the Demogorgon (yeah, the big bad is back from being on loan).
      Practice safe sponsorship. We understand that great Fan Content can sometimes require special equipment (e.g., videos, podcasts, prop fabrication). We are OK with you using third-party sponsors to subsidize costs if you follow a few rules:
      Don’t use a sponsor that would be harmful to Wizards. Please don’t promote our competitors or endorse inappropriate or offensive sponsors;
      Make it clear (verbally or visually) that they are acting as a sponsor only;
      Keep any shout-outs, mentions, and credits to a reasonable length; and
      Do not associate Wizards with your sponsor in any way.
      Follow the law of the land. It’s your Fan Content, so you are solely responsible for ensuring that your creations don’t violate the laws of your region, country, plane, or dimension. In addition to this Policy, your use of any Wizards’ IP must also comply with Wizards’ Terms of Use and Code of Conduct (together, the “Wizards Terms”). If there’s a conflict between anything in this Policy and the Wizards Terms, the Wizards Terms win. Those agreements include important legal terms (such as limitations of lability, indemnification, and dispute resolution), so please review them carefully.
      One last thing—Please don’t pull us into any legal battles! Our lawyers are busy enough. If Wizards of the Coast, our partners, affiliates, or employees get hit with any legal claims, fees, or expenses related to your Fan Content, you’re responsible for paying all of our costs (including attorney’s fees) and any resulting judgment or settlement.

      In this document, they specifically mention A&A as one of their trademarks, which they say we cannot use. So how am I supposed to make A&A fan content without that trademark? Do I have to call it some wierd and obscure name and hope people will just innately know it’s supposed to be A&A? Can I use the name A&A as long as I don’t break any of those other rules?

      As we all know, Hasbro, which owns Wizards of the Coast, which owns Avalon Hill, which owns A&A is a ruthless company which will sue the heck out of you, or force u to settle out of court and agree to terms that include selling your soul to the devil. I like my soul and would prefer not to have to part with it, so could someone please explain to me how I can make A&A fan content, specifically my Cold War game that many of you may know about, without having to face legal action?

    • Why do we all lie about our ages

      So, I’ve viewed a couple of people’s profiles and a bunch of the people I have viewed have completely ridiculous ages, like older than the oldest person that’s ever lived. Why do people do that? Is it just a internet safety/data privacy thing? Does this forum have a minimum age?

      Hi I’m militarized milkmen. My name comes from the fact that the first time I saw a french and Soviet mech infantry, I said, “That’s not mechanized infantry, that’s just milkmen trained to carry infantry instead of milk.” Hence my name, militarized milkmen.

      You all probably know me as the guy who keep reopening dead threads specifically ones I started because no one else responds to them lol.

      I encourage you to check out my Cold War threads. Me and my partner @GEN-MANSTEIN with help from @MonsieurMurdoch working on developing an adaptation of Axis & Allies (It’s closest to G40 Second Ed.) that takes place during the Cold War. We are actually currently working with Historical Boardgaming on offering our game on their site, and possibly even selling pieces (tokens, tech trees, IPC Tracking Charts, and possibly even minatures) specifically for this game!

      We are always looking for help, no I can’t pay you for it, lol. We only have three people actively working on this project, including myself, and we really could use the extra help.

      Maybe I should make a thread where all people do is put in plugs for the things they’re working on lol.

      I’m going to be completely honest. I did design a Godzooky miniature for A&A on Sculptris and printed him out. He always cost’s one more IPC then it is ever possible to have in any game and only japan could buy him. Also, all of his stats are zero because he is so useless, but he does have the ability to fly, so if you want to move a useless unit around by building an unbroken string of air bases, you can. He can’t land on carriers, be transported by any other unit, or scramble, and is instantly taken as a free casualty in combat. I thought it would be an accurate representation of how useless he was. He can however, be sent on air mission into the sea in which he has no chance of finding a suitable landing spot. That’s his only benefit because I thought it would only be fair if he had the opportunity to commit seppuku along with all of his other Japanese brethren. If anyone is actually interested in this I suppose I could post a picture and attach the file of his 3d file, but I’m guessing no one wants that.

      No everyone knows Godzooky is only spelled Godzuki in Japan, and I am clearly for America. Also, Godzooky was Godzilla’s nephew, not his daughter. Manilla and Godzilla Jr, are his sons. It’s all explained in this video. link text

      No everyone knows that Godzilla wasn’t controlled by aliens because he himself was an aliens. And without them, the US never would have won against Japan, because all of their engineering at Los Alamos was inspired by Godzillas patented Atomic Breath. It was however, a surprise that nuclear weapons even affected Japan, after they managed to defeat Godzilla, Mothra, and Godzooky during the less well known Jurassic-Japanese War.

      @Imperious-Leader That was hilarious but you missed the part when the U.S.S. Constitution was nicknamed Old Uraniumsides, after it successfully repelled a nuclear strike sent from Mars. Also, we are now talking about the Cold War, and it is no longer ridiculous to believe that military operations took place there.

      Well it really depends. Russia had and does have a multitude of secret and not so secret refueling stations in the arctic. The idea was they would be using them to bomb the united States if nuclear war broke out. Thanks to russia being russia, its unclear how much they were actually used as war never broke out. America did not have any arctic refueling stations as they did not really need them thanks to aerial refueling. Either way, no one really owned the arctic, although I can solve that, powers just owned whatever they built there.

      In antarctica, there were many more stations, owned by a multitasking of different powers, including Chile, UK, US, U.S.S.R., Brazil, Argentina, and I believe a few more. However, a majority of these stations were for research purposes only. I’m not sure what sort of research they did, exactly, up there, and Im not sure if it would even be enough to warrant a research center in the antarctica, especially since there is currently a rule requiring the territory to have a victory or capital city. However, there were almost always, military personnel on site in antarctica, and almost every base had multiple docks, harbors, air bases, and landing strips, so they would definitely warrant a territory.

      I’m thinking maybe you have to pay a certain number of IPCs for each unit you have there, and maybe you have to have some sort of open shipping lane, or be able to reach it by bomber, not sure. The territory(s) will probably be special, sort of like the sahara. It might be possible to build research centers on them, even though they do not have capital or victory cities. They will likely start controlled by no power, but with units starting in them, with the choice of taking them or abiding by international law. I will probably also make it possible to make provoked declarations of war if people capture them. Not sure.

      Apparently, many stations and bases were built in antarctica after ww2. I think it’s definitely worth including, but only if you willing to add to the map. I can create the designs as long as you can implement then if that works for you.

      Well that’s a big problem I’ve had. First of all the americans and russians have to cross the entire atlantic to bomb eachother, when in reality the could, and did, just fly north which was much easier. Also, a big part of russian nuclear doctrine was their arctic refuelling stations. However, either way the map is flat and the world is round, so I can’t think of many good solutions other than adding one or two special bottom rows that have spaces that are somewhat bigger to include the travel component. There would, of course be restrictions on movement however. I could draft something up, but it’s up to you Gen on if you wanna add it.

      The Battle of the Barents Sea was a World War II naval engagement on 31 December 1942 between warships of the German Navy (Kriegsmarine) and British ships escorting convoy JW 51B to Kola Inlet in the USSR. The action took place in the Barents Sea north of North Cape, Norway. The German raiders’ failure to inflict significant losses on the convoy infuriated Hitler, who ordered that German naval strategy would henceforth concentrate on the U-boat fleet rather than surface ships.
