It has come to our attention that your recent actions in Romania have contravened the most fundamental code of law, the bible of all interaction, we speak - of course - of the Axis & Allies Rulebook 1940 Europe Second Edition.
We refer you to Page 12 (Phase 2: Combat Move (Powers at War Only) - Sub Section Powers Not at War with One Another).
Combat: A power can’t attack a territory controlled by or containing units belonging to a power with which it is not at war.
We also refer you to the notes of G40 Balanced Mod 4.1. In subsection Rules specific to 1940 the engine does not do, but you must follow.
(PE) = Player Enforced = You must be aware of the rule and must follow it. The engine will not stop you from breaking the rule.
(PE) You may not attack a territory containing units owned by a nation that you are not at war with (even if the territory is owned by someone you are at war with).
Whilst you should be punished, we wish to be kind due to our forgiving nature (and because you keep your moustache looking so lovely and those NKVD can be a little scary). We therefore propose that those poor Italians be allowed safe passage out of the Russian-held territory into Italian-held Yugoslavia.

My goodness! I think I didn’t even notice that there are Italians in Romania, lol. At least I did not notice the friendly gathering in Romania after the battle.
I also did not understand your comment that you forgot to declare war with Italy. What would you have done if you had declared war with Italy? Is that something we could implement in the current game?
We could also interpret the situation in a way that I forgot to declare war to Italy and redo the battle for Romania - with a declaration of war against Italy beforehand.
Or we move the Italian forces to Yugoslavia. I am not sure it is in your favor. Apparently Russia unrightfully conquered Romania and received 6 IPCs including the 3 bonus IPCs.
I can also thin over what the Russian troops would have done instead of illegally conquering Romania.
I have no preference whatsoever - please take a decision which I am sure will be fair:
a) declare war with Italy in round 2 and the relevant follow-up, Germany not being impacted
b) I do something else with the troops which invaded Romania
c) the concerned Italian troops are teleported to Yugoslavia before the Italian turn
d) Russia goes back in time, declares war not only to Germany but also to Italy, and the battle for Romania is re-done.
No matter what you chose will be fine with me. In any case I would be glad if you could explain to me how to roll custom battles with Marti.

I didn’t realise Russia could go to war with Germany and attack German territories with Italians in and the Italians would not fight. TripleA allows it, but it is not allowed by the rules. Every day is a learning day…
I’m happy to take the benefit of the learning opportunity, and we don’t go back to a previous point or re-roll any battles etc… I’d be happy to move all the Italians in Eastern Europe into Yugoslavia before the start of the Italian combat move phase and go from there, they will declare war on Russia but won’t attack Slovakia/Hungary as this would can open an attack on Romania by Germany which you won’t have accounted for. How’s that for you?
It puts this game in an interesting position and means you don’t have to redo any of the Russian moves.
