Yeah, Combat and Non-Combat are 2 separate phases. It’s not the same situation as a tank activating Persia by going through NW Persia or Eastern Persia still unoccupied.So it seems to be a legal move. The fact that it is a NCM through an occupied territory makes it legal. Please feel free to get more clarification if needed.
