air units cant fly over neutral territories unless they are attacking it. If you attack with one inf and your attack fails it is still unfriendly neutral. So only way for you to fly over is to fly in as a combat move, and then you can fly out as NCM.
Declaring war on neutrals doesnt really mean anything. I think its just a tripleA thing. Only rule is that if you attack a strict neutral all the other strict neutrals go unfriendly, but they are still unfriendly neutrals and remain so until someone takes ownership (either as a successful attack or as a NCM by ally.
